Supertech Noida 63Twin Towers demolition is Right?
In what is now presented or touted as one of the biggest wins for homeowners, Supertech Twin Towers in Noida Sector 93A has been found in the dust. Close to four tons of explosives were used and what happened in a fight that lasted almost a decade by the owners’ union, which finally met its fate on August 28, 2022.
The towers together occupied an estimated built-up area of around 7.5 lakh sq. ft. After approval by the technical expert of the SC, the demolition took place through the charging of the structures. The blast took place on 28 August 2022 at around 2:30 pm. An estimated 3,700 kilograms of explosives were poured into more than 9,000 holes in the structures. The explosives were sourced from Palwal in Haryana and contained a mixture of emulsified, dynamite, and plastic elements. The explosion of a waterfall ensured that the structures collapsed inwards. The buildings were covered with black and white geotextile fibers to prevent dust balloons. Around 1,400 residents living in the area were evacuated, and movement on the Noida-Greater Noida Expressway near the site was restricted for about 30 minutes.
The developer said that out of 711 homebuyers, it had already refunded 652 buyers. The remaining 59 could not be settled due to issues with the documentation process. However, the top court reiterated its stand and asked the pending home buyers to file their claims by April 15, 2022. The Supreme Court said that the interests of home buyers will be protected.

The apex court upholds the judgment of the Allahabad High Court in a 140-page order headed by Justice DY Chandrachud and Justice MR Shah.The Court held that the approvals granted by the Authority for the construction of Towers 16 and 17 on November 26, 2009, and March 2, 2012, were in direct violation of the National Building Code (NBC) 2005, NBR 2006, and NBR 2010. The required minimum distance between structures was not followed.
Since the construction of the two towers has reduced the common area for the residents, the developer should have taken their permission before installing the towers. The top court also found the complicity of the development authority in the illegal plans of the builder. Hence, the SC ordered Supertech to refund the flat buyers at an annual interest of 12 percent. It also ordered the convicts to carry out the demolition and pay Rs 2 crore to Supertech Emerald Court RWA.
Different people can have different views on the post that despite of wrong doing supreme court can open a hospital or school in that place. But that will create the wrong impression that in India corruption is tolerated and rich people can mend the law according to their will.
